Definition An outlandish legal tack that has been used (thankfully without success) by attorneys representing defendants accused–and later convicted–of a range of crimes, including homicide, hit-and-run car crashes and sexually inappropriate groping.

Comments The defense argues that the perpetrator’s actions were attributable to transient caffeine-induced psychosis (caffeine intoxication), and he should be granted leniency or a reduced sentence. 

The ploy owes its parentage to the successful Twinkie defense used by San Francisco Supervisor Dan White’s legal eagles, to reduce his conviction from first-degree murder to voluntary manslaughter, which carries a lesser sentence.
