Definition A temporary or permanent mental state in which the perpetrator of one or more criminal acts lacks the capacity to understand that the acts were unlawful.
Note: Mental health workers and the legal profession have struggled with definitions for the words insane and insanity. Insanity under the law was first examined by English high court in M’Naghten 1843 10 C & F 200, and revisited by many other courts. In essence, the criminal act (actus reus) cannot be linked by judge or jury to criminal intent (mens rea). The author’s above composite definition is probably as good as any. by the perpetrator
